This website is operated by Edward Jack Humphrey (‘Edward’, ‘the artist’). By visiting the website or purchasing an artwork, you agree to these Terms of Service, together with the Shipping Policy, Returns Policy and Privacy Policy. Please read them before using the site. Nothing in these Terms limits your rights under the Australian Consumer Law.

The store is hosted on Shopify, which provides the e-commerce platform used to sell artworks.

1. Using the Site
You must be at least 18 years old, or have a parent or guardian’s consent, to make a purchase. You must not use the site for any unlawful purpose, transmit viruses or malicious code, or interfere with the site’s security. Edward may restrict access to anyone who breaches these Terms.

2. General Conditions
You agree not to reproduce, copy, resell or exploit any part of the site or its content without Edward’s written permission. Credit card information is always encrypted during transfer. Other information you submit may be transmitted unencrypted across networks.

3. Artworks and Colours
Each artwork is an original, one-of-a-kind piece, so availability is limited to one. Edward takes care to photograph each artwork as accurately as possible, but colours, texture and surface finish may look different on your screen. Sizes and descriptions are provided in good faith.

4. Copyright and Intellectual Property
Edward retains the copyright and moral rights in all artworks, images and other content on this site. Buying an artwork transfers ownership of the physical piece only. It does not give you the right to reproduce, print, publish or license the image, in whole or in part, without Edward’s written permission.

5. Pricing, Orders and Errors
Prices are in Australian dollars unless stated otherwise and may change before an order is placed. If an order has been placed with a pricing or listing error, Edward will contact you and give you the choice to proceed at the correct price or receive a full refund. Edward may decline or cancel an order (for example, if an artwork is no longer available or there is a suspected fraudulent payment) and will refund you in full if payment has been taken.

6. Billing and Account Information
You agree to provide current, complete and accurate information when you buy, so that your order can be processed and delivered.

7. Shipping and Returns
Shipping is covered in the Shipping Policy and returns in the Returns Policy. Please read both before buying.

8. Third-Party Tools and Links
The site may include third-party tools or links to other websites. Edward is not responsible for third-party content, products or services, so please check their terms and policies before using them.

9. Comments and Submissions
If you send Edward comments, ideas or other material, you give permission for it to be used, edited or published without payment. You agree not to submit anything unlawful, defamatory, abusive or infringing on someone else’s rights, or anything containing malicious code. Edward may remove content that breaches these Terms.

10. Personal Information
Your personal information is handled in line with the Privacy Policy.

11. Prohibited Uses
You must not use the site to break any Australian or international law, infringe intellectual property rights, harass or discriminate against others, submit false information, spam, scrape or crawl the site, or interfere with its security or operation. Edward may restrict your access if you do.

12. Consumer Guarantees and Limitation of Liability
Edward’s artworks come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Subject to those rights, and to the extent permitted by law, Edward is not liable for indirect or consequential loss arising from your use of the site, and the site is provided without a guarantee that it will always be uninterrupted or error-free.

13. Termination
These Terms apply for as long as you use the site. Edward may restrict access to the site if you seriously or repeatedly breach these Terms. Any rights and obligations that arose before then continue.

14. General
If any part of these Terms is found to be unenforceable, the rest still applies. These Terms, together with the policies listed above, are the entire agreement between you and Edward. These Terms are governed by the laws of New South Wales, Australia, and both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

15. Changes to These Terms
Edward may update these Terms by posting the new version on this page. The version in place when you place an order applies to that order.
